Zoning, setbacks and what varies by city 1. Fees, inspection sequence and duration The building code exempts detached one-story accessory structures of 120 square feet or less from a building permit. That exemption covers the structure only. It never covers gas, electrical or plumbing, and it never overrides zoning setbacks, height limits, hillside rules or coastal review. So a freestanding BBQ island typically needs no building permit while its gas line and its GFCI circuits do. A 16 by 20 foot patio cover needs a permit everywhere. Budget $400 to $1,500 for a patio cover permit and $200 to $600 for the gas and electrical. In this article 1. The 120-square-foot exemption and its limits 1. Patio covers: what Appendix H requires 1. Outdoor kitchens: the island is easy, the utilities are not 1. Roofs, clearances and ventilation 1. Zoning, setbacks and what varies by city 1. Fees, inspection sequence and duration #### The 120-square-foot exemption and its limits Both the California Building Code and the California Residential Code exempt one-story detached accessory structures (tool sheds, playhouses and similar uses) with a floor area not exceeding 120 square feet from the requirement for a building permit. Four things the exemption does not do. It does not exempt electrical, gas or plumbing work. Those need their own permits regardless of the structure's size. It does not exempt you from zoning. Setbacks, lot coverage, accessory structure placement and height limits still apply, and a structure built in a required yard is a violation even without a building permit. It does not apply to attached structures. Anything bolted to the house is part of the house. It does not travel to every plan check counter cleanly. Jurisdictions differ on whether an open pergola qualifies, and several require permits for any roofed structure regardless of area. Ask your building department directly before assuming you are exempt. Pro Tip Get the exemption confirmed by name and date from the counter, and keep the email. #### Patio covers: what Appendix H requires The California Residential Code has a dedicated appendix for patio covers, and it defines the category tightly. A patio cover is for recreational outdoor living only, not a carport, garage, storage room or habitable room. Enclosure walls may be almost any configuration provided the open or glazed area of the longer wall and one additional wall totals at least 65 percent of the wall area below six feet eight inches. Close it in beyond that and it stops being a patio cover and becomes an addition, with a very different code path. Minimum ceiling height is seven feet. Roofs are designed for a minimum live load plus wind and seismic forces, which is why an attached cover needs a properly engineered ledger connection into the rim joist or a through-bolted beam, not lag screws into stucco. Cost: timber structures $9,500 to $20,000; aluminum louvered systems $18,000 to $40,000 depending on span, usually supplied with an ICC-ES evaluation report covering the engineering. Pro Tip If you think you may glaze it in later, design it as an addition now. Converting a patio cover afterwards means starting the permit over. Ready to Start Your Project? Everything running to it is. Gas. New piping requires a plumbing permit, sizing calculations under the California Plumbing Code, and a pressure test, commonly air at not less than 10 psi held for 15 minutes. Sizing is where projects fail. A built-in grill draws 60,000 to 90,000 BTU per hour, a side burner 15,000 to 30,000, a gas fire pit 65,000 to 150,000, and a pool heater up to 400,000. A typical residential meter cannot carry all of that at once, so a meter upgrade request to the utility often becomes part of the job. Electrical. GFCI-protected circuits, weather-resistant devices with in-use covers, dedicated circuits for a refrigerator or ice maker, and load calculations that may push an older panel past capacity. Plumbing. A sink must drain to the sanitary sewer. A dry well or a pipe to the planting bed is not an approved disposal method. Pro Tip Total the BTU demand of every gas appliance before design, including any future pool heater. Meter capacity is the hidden constraint. #### Roofs, clearances and ventilation Putting a solid roof over the cooking area changes the job significantly. An open pergola with a 65 percent open roof structure gives a grill room to breathe. A solid roof does not, and grill manufacturers publish minimum vertical clearances to combustible construction: commonly 30 to 36 inches above the cooking surface for an open-air installation, more under an enclosed ceiling. Under a solid roof, expect the building department to look for a listed ventilation hood, and expect the manufacturer's installation instructions to govern, because the code adopts them. Appliances themselves must be listed for outdoor use. An indoor range or indoor-rated refrigerator installed outside is both a code violation and a warranty void. Materials matter too. Non-combustible construction around the grill body, proper insulating jackets where a built-in grill sits in a masonry surround, and stainless or marine-grade fasteners in coastal areas from Malibu to Newport Beach where salt air eats plain steel within a few seasons. Pro Tip Order the grill before framing the island. Cut-out dimensions and clearance requirements vary by model and are not standardized. #### Zoning, setbacks and what varies by city This is the part that varies most across Southern California, and the part homeowners most often skip. Accessory structures are typically restricted to rear yards, with maximum heights well below the main dwelling and required distances from property lines and from the main house. A patio cover attached to the house is usually treated as part of the main building for setback purposes, which means it must respect the same rear and side yard requirements. Some cities count a solid-roofed cover toward lot coverage while treating an open lattice or louvered structure differently. Some limit the percentage of a rear yard that may be covered. Hillside lots pick up the extra layer of grading, height and access rules. Coastal Zone properties may require a Coastal Development Permit for a structure that would be routine three streets inland. Check three numbers before design: rear setback, side setback and maximum accessory structure height. Pro Tip Verify property lines with a survey if you are building within three feet of one. Fences are frequently not on the line. #### Fees, inspection sequence and duration The paperwork is modest compared with the construction. Patio cover permit and plan check: $400 to $1,500 depending on valuation and city. Gas and electrical permits: $200 to $600 combined. Structural calculations where a proprietary engineered system is not used: $900 to $2,500. Aluminum louvered systems usually arrive with an evaluation report that covers this. The inspection sequence for a covered outdoor kitchen runs: footing inspection before concrete, then framing along with rough electrical and the gas pressure test, then final once appliances, devices and finishes are in. Construction duration for a pergola and outdoor kitchen combination is typically three to six weeks on site, longer if a proprietary aluminum system has a lead time or if the utility has to touch the meter. The cost of skipping all this shows up at resale: retroactive permitting on an existing structure, opening finished work for inspection, or demolition. It is a poor trade for a few hundred dollars saved. Pro Tip Schedule the footing inspection before the concrete truck, not the same morning. A failed call costs a full delivery. #### Final Thoughts The rule of thumb is simple. Structures over 120 square feet, anything attached to the house, and anything with gas, electricity or a drain need permits. A freestanding island on a slab usually does not, right up until you connect it to something. Confirm setbacks and meter capacity before design, pull the utility permits without argument, and the whole outdoor room comes together in three to six weeks. It depends on size, height and jurisdiction. The code exempts detached one-story accessory structures of 120 square feet or less, but counters differ on whether an open pergola qualifies, and many require a permit for any roofed structure. Anything attached to the house needs one regardless. Zoning setbacks and height limits apply either way. Does a BBQ island need a building permit? The island itself usually does not. It is a site-built counter on a slab, not a structure. The utilities do. New gas piping needs a plumbing permit with sizing calculations and a pressure test, typically 10 psi held for 15 minutes. GFCI circuits need an electrical permit, and any sink must drain to the sanitary sewer. Can I run a new gas line off my existing house supply? Sometimes. It depends on meter capacity and pipe sizing. A built-in grill draws 60,000 to 90,000 BTU per hour, a fire pit 65,000 to 150,000, and a pool heater up to 400,000. Add them up before design. If the total exceeds meter capacity you need a utility meter upgrade, which is a separate request with its own lead time. What does a patio cover permit cost? Plan check and permit fees generally run $400 to $1,500 depending on project valuation and the city, plus $200 to $600 for gas and electrical permits if the outdoor kitchen is included. Structural calculations add $900 to $2,500 unless you use a proprietary aluminum system supplied with an ICC-ES evaluation report covering the engineering.
